These Terms of Service set out the contractual framework for using our Platform. They are not themselves personal legal, tax, or Sharia advice. OI Real Estate provides financial and investment consultation as described in these Terms; specific recommendations are given in the context of your enquiry. Property transactions involve significant legal and regulatory requirements — you should also obtain independent professional advice where appropriate.

These Terms of Service (“Terms”) govern your access to and use of the OI Real Estate website and platform at oirealestateksa.com (the “Platform”) operated as part of the Original Identity group of projects.

OI Real Estate operates as a real estate broker and developer in the Kingdom of Saudi Arabia, marketing and delivering investment and residential opportunities—including our own development projects—while providing financial and investment consultation and supporting international buyers, particularly in the United Kingdom.

By accessing or using the Platform, submitting an enquiry, or communicating with us, you agree to these Terms. If you do not agree, you must not use the Platform.

2. Nature of the Service

OI Real Estate is a real estate brokerage and development business operating in the Kingdom of Saudi Arabia. Through the Platform and our advisory team, we market properties and projects—including developments managed or promoted by OI Real Estate—and assist buyers, particularly Muslim residents in England, to identify, evaluate, and progress purchases and investments in Saudi Arabia.

Our services may include brokerage, project marketing, financial and investment consultation, investment introductions, coordination of viewings, due-diligence support, and liaison with lawyers, valuers, and Sharia-compliant finance providers. Specific services applicable to your enquiry will be confirmed in writing where required.

  • We operate as a real estate broker in Saudi Arabia and undertake development and investment projects in the Kingdom, in compliance with applicable laws including Real Estate Authority (REGA) regulations on brokerage, advertising, and licensing.
  • Our UK presence provides advisory, financial consultation, and client-support services for overseas property acquisition; marketing Saudi property to UK consumers is subject to applicable UK consumer protection laws.
  • We provide financial and investment consultation related to Saudi real estate — including feasibility analysis, return expectations, financing structures, capital planning, and exit strategies — as part of our advisory offering.
  • We do not act as your legal representative, notary, or conveyancer. Title transfer, Ejar registration, and municipal compliance require licensed Saudi lawyers and official channels.
  • Sharia-compliant finance guidance we provide is advisory in nature and is not a substitute for a formal fatwa or binding Sharia ruling — consult qualified scholars and licensed finance providers for product-specific rulings.

3. Financial & Investment Consultation

OI Real Estate offers financial and investment consultation to clients seeking to acquire, hold, or exit Saudi real estate assets. Consultation is typically provided in connection with a specific property, project, or portfolio objective and may be delivered by our in-house advisory team or designated consultants.

  • Investment feasibility, comparative analysis, and indicative return modelling for Saudi property opportunities.
  • Guidance on financing structures, instalment plans, and introductions to Sharia-compliant and conventional finance providers where appropriate.
  • Support with capital allocation, holding strategy, rental yield optimisation, and planned exit timing.
  • Coordination with valuers, accountants, and legal advisers as part of an integrated transaction plan.

Important limitations

Financial consultation we provide focuses on real estate investment in Saudi Arabia. It does not replace independent tax advice in your country of residence, legal advice on title and contracts, or product-specific Sharia certification.

Where a transaction involves regulated financial products (e.g. securities, regulated credit, or insurance), execution is through appropriately licensed banks, finance companies, or advisers in Saudi Arabia or the UK, and we will identify the regulated provider responsible for that product.

Past performance, projections, and market commentary are not guarantees of future results. All investment decisions remain your responsibility after reviewing written materials we provide and any independent advice you choose to obtain.

4. Regulatory & Compliance Framework

Kingdom of Saudi Arabia

  • Real Estate Authority (REGA) Law and implementing regulations — brokerage, property advertising, fal licences, and development marketing.
  • We conduct brokerage and development activities in Saudi Arabia in accordance with REGA requirements and our registered establishment status (unified no. 7053331117).
  • E-Commerce Law (Royal Decree M/126) — electronic commercial practices.
  • Personal Data Protection Law (Royal Decree M/19) — see our Privacy Policy.
  • Anti-Money Laundering Law and Counter-Terrorism Crimes Financing regulations — all parties must comply with KYC/AML in transactions.
  • Foreign ownership rules — non-Saudi buyers must verify eligibility under applicable Ministry of Housing / MOJ / REGA rules.
  • Where financial consultation touches regulated investment or financing products, applicable rules of the Capital Market Authority (CMA), Saudi Central Bank (SAMA), and other competent authorities apply to the licensed provider of that product.

United Kingdom

  • Consumer Rights Act 2015 — information about services must be clear; remedies may apply to misdescribed consumer services.
  • Consumer Protection from Unfair Trading Regulations 2008 — prohibits misleading actions and omissions.
  • Unfair Terms in Consumer Contracts Regulations 1999 — certain terms may be unenforceable if unfair.
  • UK GDPR / DPA 2018 — see Privacy Policy.
  • Financial Services and Markets Act 2000 / FCA Handbook — where UK-regulated financial products are involved, the relevant authorised firm will be identified; our real estate and overseas-property consultation is distinct from regulated investment advice unless expressly agreed in writing with an authorised person.
  • Money laundering regulations — users must not use the Platform for unlawful purposes.

5. Eligibility & Account Use

  • You must be at least 18 years old (or age of majority in your jurisdiction).
  • You must provide accurate enquiry information.
  • Admin accounts are restricted to authorised personnel; you must keep credentials confidential.
  • You must not scrape, reverse engineer, or overload the Platform.

6. Property Listings & Information

Listings may relate to properties and projects marketed directly by OI Real Estate (including our development projects), or to opportunities offered jointly with verified partner developers and agents. We apply verification steps where indicated (e.g. “verified” badges) but you must independently confirm details before committing.

  • Prices in SAR are authoritative; GBP/EUR displays are indicative conversions for guidance only and not offers.
  • Floor plans, photos, and descriptions may differ from the actual property — independent inspection (physical or video) is essential.
  • Title deeds (Sak), REGA advertising licence numbers, and municipal approvals must be independently verified before payment.
  • Location pins may be approximate for privacy — see listing disclaimers.

7. Enquiries & Introductions

Submitting an enquiry authorises us to use your contact details to respond and progress your request. Where OI Real Estate acts as broker or developer for a listed property or project, we may deal with you directly. Where a third-party seller or partner is involved, we may share your enquiry with them under appropriate confidentiality and data protection safeguards.

Any binding contract for purchase, investment, or brokerage will be documented in writing with clear identification of the contracting party (OI Real Estate and/or the relevant seller, developer, or partner), fees, and applicable terms.

8. Fees & Payments

Brokerage, financial consultation, marketing, or advisory fees (where applicable) will be disclosed clearly in writing before you incur them. Browsing the Platform is generally free for buyers unless otherwise stated for a specific service.

Property purchase funds must be transferred only through approved escrow, lawyer trust accounts, or official payment channels in Saudi Arabia as advised in your transaction documentation — never based on unsolicited instructions.

9. Intellectual Property

Platform content, branding, logos, and software are owned by or licensed to OI Real Estate / Original Identity. You may not copy, reproduce, or commercially exploit content without written permission. Listing media remain owned by respective agents/photographers.

10. Acceptable Use

  • No unlawful, fraudulent, or discriminatory use (Equality Act 2010 compliance).
  • No harassment of staff or agents.
  • No uploading malware or attempting unauthorised access.
  • No misrepresentation of identity or financial capacity.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Platform is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation.
  • We are not liable for acts or omissions of third-party agents, developers, banks, or legal advisers.
  • We are not liable for indirect, consequential, or economic loss arising from reliance on listings or general Platform information.
  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK Consumer Rights Act 2015, Saudi consumer protection rules, or other mandatory law.

Cap on liability (business users)

Where you use the Platform wholly or mainly for business purposes and exclusion is permitted, our aggregate liability arising from these Terms is limited to the greater of (a) fees paid by you to us in the 12 months before the claim or (b) GBP £100 / SAR 500, except where prohibited by law.

12. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, unlawful use of the Platform, or misinformation you provide, except to the extent caused by our negligence or wilful misconduct.

13. Governing Law & Jurisdiction

If you are resident in the United Kingdom

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections allowing you to bring claims in your home UK jurisdiction where applicable under the Consumer Rights Act 2015 and Rome I/II regulations.

If you are resident in the Kingdom of Saudi Arabia

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be subject to the jurisdiction of the competent courts in the Kingdom, without prejudice to mandatory consumer protections under applicable Saudi regulations and the E-Commerce Law dispute mechanisms where applicable.

Cross-border users

Where you access the Platform from outside the UK or KSA, you are responsible for compliance with local laws. If a conflict arises between mandatory local law and these Terms, mandatory law prevails to the minimum extent required.

14. Complaints & Dispute Resolution

Contact info@oirealestateksa.com first with any complaint. We aim to respond within 14 business days.

UK consumers may also refer eligible disputes to approved alternative dispute resolution schemes where applicable.

KSA users may pursue remedies under the E-Commerce Law and applicable consumer protection regulations before competent authorities.

15. Suspension & Termination

We may suspend or restrict access for breach of these Terms, fraud prevention, or legal compliance. You may stop using the Platform at any time.

16. Changes to Terms

We may update these Terms. Continued use after posting changes constitutes acceptance where permitted by law. Material changes affecting UK consumers will be highlighted; where required, we will obtain explicit acceptance.

17. General

  • Severability: invalid provisions do not affect the remainder.
  • No waiver unless in writing.
  • These Terms with the Privacy Policy and Cookie Policy constitute the entire agreement regarding Platform use.
  • English and Arabic versions: in case of inconsistency, the version matching your selected locale prevails for interpretive convenience; mandatory law governs where conflict exists.
